RIGHTS AND OBLIGATIONS OF USERS
USER REGISTRATION
The purchase of products on the Cataruz website requires the User to register as a customer. The data entered must be accurate, current and truthful. The user will be responsible at all times for the custody of your password, assuming any damages that may arise from its misuse, as well as the transfer, disclosure or loss of this.
SALES AND PRICES
To be able to use the services of our web page it is necessary to be of legal age. In Spain, the User must be over 18 years of age.
By accessing our website, the User declares that he/she is of legal age in his/her country. The User is solely responsible for knowing the regulations regarding the sale of alcoholic beverages in his/her country.
Cataruz reminds you that alcohol abuse is dangerous for your health and recommends that you consume it in moderation.
The prices of all products include VAT (21%) and are subject to change without notice. The same applies to special offers and promotions.
METHODS OF PAYMENT
All orders must be paid in advance in full by bank card (VISA debit or credit card and Mastercard), or Stripe.
Refunds will be made by the same payment system used by the User to pay for the order and once we have received the products to be returned at our facilities in Valencia (C/Albacete 48-11- Valencia).
All payments that are suspected of fraud will be suspended until the anti-fraud check is resolved. If a more rigorous investigation is required, the approval and dispatch of the order may be extended.
At the time of delivery of the order, please:
- Check that the package(s) are in good condition.
- If the box is damp or wet, do not accept the package and notify us at cataruzsl@gmail.com. We will send you a replacement of the damaged product(s) free of charge.
Cataruz is not responsible for the consequences of possible delays in shipment.
CANCELLATIONS AND RETURNS
Orders that are cancelled before the shipment is dispatched will be refunded free of charge. In the case of receiving notice of cancellation once the package has been shipped, it will be considered a return.
Returns can be made up to 14 calendar days from receipt of the product. A return cannot be made if there are indications that the products have been opened, tampered with or exposed to unsuitable conditions. Products must be returned correctly protected, in their original packaging and in perfect condition.
If the reason for the return is simply that the wine does not meet your expectations and you had bought more bottles, you can return the remaining unopened bottles within 15 days. Once we have checked that the bottles have been received in perfect condition, we will refund the cost of the bottles. The cost of returning the bottles will be paid by the customer.
Any return due to breakage or incident during transport must be communicated to our incident department (cataruzsl@gmail.com) within 24 hours of delivery of the bottles, attaching all the necessary information such as photographs of the condition of the bottles or packaging. In this case, the return and/or replacement of the affected bottles will be free of charge for the customer, or recipient (in the case of a gift).
No package will be accepted if it does not have the buyer’s identification elements (order number, name, surname and address).
The return of the products ordered will give rise to the reimbursement of the full amount paid by the customer minus the cost of transport in the event that it complies with this point. No refund will be made before receiving the products to be returned in our warehouse.
We will not accept any exchange or return if we have not previously received any notification and the reason for which the order is being returned to the e-mail address cataruzsl@gmail.com. The address for receiving returns is: Calle Albacete 48-11 Valencia 46007).
APPLICABLE LAW AND DISPUTE RESOLUTION
The General Conditions of Use and Sale set out herein are subject to Spanish legislation and the Spanish version will be the only one with legal validity and will prevail in the event of discrepancy between the versions published on the different CATARUZ websites.
The place of conclusion of the sale to which these General Terms and Conditions are subject shall be determined in accordance with the provisions of Council Regulation (EC) 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. SHIPPING
The order will be sent to the delivery address specified during the purchase process. We have a courier company that can send the product to any point of the Peninsula and Balearic Islands.
The amount of the shipment will depend on the area to which the delivery must be made and the amount of the same, IT WILL APPEAR AUTOMATICALLY SPECIFIED BEFORE MAKING THE PAYMENT, WHERE THE PRICE OF THE ORDER AND THE PRICE OF THE CARRIAGE ARE SHOWN IN BREAKDOWN.
Keep in mind that for delivery times to be met you must place your order before the cut-off time which is 17:00 hours. After this cut-off time, the order will be processed the following day, as we are unable to deliver it to the transport company. Please note that the cut-off time depends on the selected transport.
As soon as payment is received, the order will be prepared immediately.
We will send you an email to the address you specified in the registration process informing you when we have proceeded with the shipment. We will also monitor the delivery and contact you if there are any problems. That is why we ask you to provide us with a telephone number in the order process.
DELIVERY DAY AND TIME
Please note that transport companies only work from Monday to Friday. They do not deliver on Saturdays or, of course, Sundays or public holidays. In addition, when we give you approximate delivery dates, we do not take into account whether it is a local or regional holiday at the destination; we only consider national and local holidays at the place of origin.
We cannot guarantee a delivery time. The transport companies will be able to deliver during the agreed day before 20:00. However, an approximate time may be given which the company will try to meet, but is not obliged to do so. If you cannot be reached, the transport company will try a second delivery agreed with you. If after the second attempt you cannot be located, you will have to pick up the order at the transport company’s premises.
UNDELIVERED ORDERS
If an order is sent and cannot be delivered for reasons attributable to the customer, the amount paid for shipping costs will not be refunded, having to pay again other shipping costs for the reshipment of the goods.
RESPONSIBILITY FOR DELIVERY TIMES AND CARRIERS
Delivery times are approximate and cannot be taken as a guarantee, although we generally meet them in 90% of orders. In exceptional cases, we reserve the right to modify the transport company with which we will send you the package, but always maintaining the transit times.
The responsibility of cellercataruz.com is limited in cases of force majeure (strikes, adverse weather conditions that prevent normal traffic by land, sea or air,…). In these cases, orders will be delivered as soon as possible, and the deadlines indicated above will not apply.
In the purchase process you must register in the cellercataruz.com database the first time, from then on, you will only have to log in with your user data and password.
